ecently, the US. Courts of Appeals for the Eleventh and D.C. Circuits issued a joint order vacating and remanding Orders 636, 636-A, and 636-B. The courts found that the whole thing was a bad idea, unsupported by the factual findings necessary for action under Section 5 of the Natural Gas Act. Based upon the Cornmission's long-awaited economic-impact studies, the courts further found that the $4billion annual benefit expected from the Order 636 initiative was not evenly spread among market sectors. In fact, said the courts, nobody in the natural gas business would get any of the benefit-most of the $4 billion went to revitalize the airlines and hotels used for nationwide restructuring meetings.
