Possible changes in the United States product liability laws have been identified as having an increasing negative influence on the engineering design process. This paper considers a specific case of a materials failure which has recently been argued through the English courts under the 1987 Consumer Protection Act. This act, and its interpretation, is discussed with regard to its possible future impact on the design rationale.
