✦ Synopsis


The lockout represents the longest labour dispute in Oklahoma's industrial history. The National Labor Relations Board has apparently upheld the complaint against Continental Carbon that it indulged in "unfair labour practices" by imposing drastic reductions in wages and associated employee benefits. Last year, PACE -together with the Ponca Indian Tribe of Oklahomafiled a lawsuit charging Continental Carbon with past and continuing violations of Federal Water Protection laws through the unsafe, improper and unauthorised operation of its Ponca City plant in Kay County. The lawsuit seeks a declaratory judgment, injunctive relief, the imposition of civil penalties, and the award of costs, including attorneys' and expert witnesses' fees, for Continental Carbon's violations. It is said that violations of the Clean Water Act (CWA) can result in penalties of up to $25,000 per day in respect of each violation. In a separate development, the City of Columbus (Georgia) and various representatives of local businesses have filed a lawsuit alleging excessive pollution from the Phoenix, AL carbon black plant. A lawsuit has also been filed in respect of Continental Carbon's plant at Sunray (Texas), where PACE alleges that Continental Carbon failed to maintain proper health and safety records.
