Joint Commission report is privileged under state's peer review act
Plaintiff filed a medical malpractice action against the hospital and against her physicians. During discovery, she requested several documents from the hospital, which the hospital objected to on the grounds that those items were privileged under state statute. The statute the hospital relied on provided that the proceedings and records of peer review committees are confidential and not subject to discovery or introduction into evidence in any civil action arising out of the evaluation and review by such committee. Plaintiff first requested all incident reports ever filed concerning the defendant physicians. In addition to claiming privilege under the statute, the hospital said the request was overbroad and that it sought information not reasonably calculated to lead to evidence that would be admissible at trial.
