As counsel to an independent power developer unaffiliated with any utility, I can see the appeal of amending PUHCA. By broadening to include all wholesale sellers the exemption from PUHCA that is now granted cogenerators and other "qualifying facilities" (QFs), the bill would allow independents to develop resources of all kinds for sale to utilities.
