In late January, the last sitting Democratic commissioner left the SEC. Commissioner Annette Nazareth joined Commissioner Roel Campos, who left in the fall of 2007.

While potential successors for these vacancies have surfaced, it will be interesting to follow the events during the coming months. Given the election of a new president in November, any nominations by President Bush, who must also win approval from the U.S. Senate, may be delayed.

The issue of three sitting commissioners did not go unnoticed by Commissioner Kathleen L. Casey, who spoke at the winter meeting of the Practicing Law Institute. In her remarks, Commissioner Casey noted that it was not uncommon for the Commission to be at less than full strength. In fact, in the mid-1990s for a six-month interval there were only two sitting commissioners, Chairman Levitt and Steven Wallman.
