to the D.C. Circuit's decision in Associated Gas Distributors v. FERC, 893 F.2d 349 @.C. Cir. 1989)(AGD II); Certiorari had been denied by the U.S. Supreme Court on October 9,1990. Tennessee Gas Pipeline Company, whose Order 500 take-or-pay settlement case was the subject of AGD 11, wasted no time making its filing in response to Order 528. Its filing is an excellent example of the complex issues faced by the pipelines and everyone interested in the gas industry (including industrial end users) in sorting out the aftermath of AGD 11.
