Despite deciding a record-low number of cases last year, 1 the Supreme Court made headlines with a handful of 5-4 decisions on such showstopping issues as affirmative action, 2 abortion, 3 global warming, 4 and the death penalty for the mentally ill. 5 At the other end of the spectrum are a near half-dozen cases that concern this article. With the usual lack of fanfare, the Court ruled on several issues that rarely sell newspapers but that greatly affect employers, employees, unions, employment-law counsel, and human resources professionals. Though they received virtually no media attention, the following cases present noteworthy developments across a wide range of labor and employment law topics. This article recounts employment-law decisions with significant holdings of the Court's last term. 6 The Court appears to have continued its recent trend of issuing primarily pro-employer decisions, although unlike the highly controversial cases previously mentioned, several of the following employment decisions were unanimous. The article concludes with a preview of employment-law cases on the docket for the current term (October 2007-October 2008), and briefy describes those cases recently decided in February 2008.
