Overview of FERC Order 497 and State Standards of Conduct
In addition to the existing oversight of affiliate transactions, many of the states have considered or adopted standards of conduct to govern transactions between a utility and its marketing affiliate. Using the state's jurisdiction over the utility, these standards prescribe what utility affiliates can and cannot do in the energy supply marketplace. Some state commissions have issued standalone regulations generic to all gas and/or electric utilities, while others are company-specific and approved in either unbundling orders or rate proceedings.
