Toxicology and safety issues in alcohol reconstruction experiments
Sir: Occasionally, toxicologists or pharmacologists are asked in court whether they have tested an accused to determine pharmacokinetic parameters relevant to a blood alcohol calculation or extrapolation at a particular point in time. Such testing takes place in a variety of locations, including hospitals and universities, private offices, home offices and homes of the accused. When laboratory or office insurance is being acquired or renewed, insurance companies, on safety grounds, argue that these places are analogous to "taverns", dispensing alcohol to patrons with all the ensuing risks. Some companies deny insurance coverage; others charge excessive premiums and exclude professional liability.
