identity of an author of what has hitherto been a work of unknown authorship becomes known before the end of the 70-year period relevant to such a work, then a term of author's life plus 70 years shall apply.The application and enforcement of this provision to databases stored and accessed on networks, including the Internet, is a daunting prospect. The phrase 'available to the public' in Section 12( 3) is open to a number of interpretations. How will this apply, for example, to closed user groups, or to databases set up and used only on intranets, or to closed user groups on the Internet?
By operation of Section 12(6), if a database falls within the definition of an 'EU database', but its author is not a national of an European Economic Area (EEA)13 country, then the term of protection extended to that database within the UK will be that of the country of origin, provided that this does not exceed the relevant UK term.
