I the commission added some significant clarifications to the terms of Order 637, a longawaited order adopted in February 2000. The most important new issues addressed in this lengthy rehearing order deal with two kinds of problems: (a) some of the specific terms and conditions of the new policy whereby price caps are suspended on LDCs' short-term capacity releases and (b) the need to redefine the rights and duties of both LDCs and pipelines under right of first refusal (ROFR) policy in the era of light-handed regulation.
