On April 8, we all got to see the final product of the Commission's deliberations on the restructuring of the pipeline industry. As I wrote last month, that product, Order 636, fixed the most fatal practical problem in the original Mega-NOPR proposal. It appears to give us the tools to recreate today's reliability after sales service is unbundled.
These tools are twofold: (1) a no-notice delivery service, available as a customer option, and (2) sufficient operating conml by the pipeline to make sure everything works.
So is everythmg okay now? Is the industry stabilized, under the guidance of a well-thought-out set of rules with which everyone can comply? Not really. There is still a real question as to whether this hip is necessary, but the Commission's scheme can be made to work, through a lot of negotiation and through some flexibility not yet exhibited by the Commission.
