Napster back in court
The recording industry is again trying to sue music sharing site Napster, despite the fact that it ceased and desisted swapping copyrighted material in July of this year.
"We will argueβ¦seeking a summary judgement against Napster on the issue of liability, which would in essence leave for trial only the amount of damages and the nature of the injunction," said Russell Frackman, an attorney for the record industry.
Labels, including AOL Time Warner's Warner Music, EMI Group Plc. and Bertelsmann AG's BMG, Vivendi Universal's Universal Music and Sony Music, will see Napster in federal court in San Francisco this month.
Napster lawyers will argue for a full trial to determine its liability. Liability could run into billions of dollars.
It claims that as it has been struggling to become a membership-charging service, it does not deserve to have the matter treated as an open and shut case.
