This article considers the existing and somewhat confusing position of Internet Service Providers (ISPs) under French law and the likely effect that the French draft Bill to promote confidence in the digital economy, the "LEN" (projet de Loi pour la confiance dans l'Economie Numérique), will have. It looks at how the LEN seeks to define their liability and thereby clarify the role and responsibility of ISPs, whose potential liability has been in the balance for a number of years now in many countries including France. The extent of clarification provided by the new law has been much anticipated; just how responsible are ISPs to be in France?
