β¦ Synopsis
OFTEL, in conjunction with the Office of Fair Trading, (OFT) has recently issued a formal consultation draft of the guidelines for the application of the Competition Act 1998 in the telecommunications sector. The consultation period for the draft guidelines ran until 26 February 1999. Given that the Act will be enforced concurrently by the Director General of Fair Trading and the sector regulators, the Director General of Fair Trading is required, in conjunction with the regulators, to prepare such guidelines. The regulators themselves may also issue guidelines specific to sectors in which they have concurrent jurisdiction with the Director General of Fair Trading. These guidelines have thus been issued to give some indication on how the Competition Act will be applied in the telecommunications sector, and they focus on the idiosyncrasies of the telecommunications sector.
