I ering orders establishing new procedures for interstate pipelines desiring to abandon gathering facilities. Formerly, such pipelines were only required to file abandonment applications pursuant to Section 7 of the NGA. Now, however, interstate pipelines must also make a filing pursuant to Section 4 of the NGA in order to receive approval to abandon gathering services.
Abandonment of Gathering Facilities
Until December 2, 1994, interstate pipelines
seeking to abandon gathering facilities (e.g., by transferring gathering facilities to an affiliate or to an unaffiliated third party) were required to make a FERC filing pursuant to the requirements of Section 7 of the NGA. This statutory provision addresses abandonment of jurisdictional facilities and related services:
No natural gas company shall abandon all or any portion of its facilities subject to the jurisdiction of the Commission, or any service rendered by means of such facilities without the permission and approval
