Authorship of cinematographic or audiovisual works -
The Commission issued a report to the Council on 6 December 2002 on the harmonisation of the notion of authorship in cinematographic and audiovisual works. Directive 92/100/EEC on rental and lending rights and certain rights related to copyright, which paved the way for harmonisation amongst Member States, recognises the principal director of a film as one of its authors. At the time the Directive was debated, a number of Member States were fundamentally opposed to this provision, arguing that it would hamper distribution and marketing by adding to the number of authors whose permission is needed for a work to be shown. The report concluded that the Directive, and specifically the provision relating to director's rights of authorship, did not make it more difficult to distribute and market audiovisual works.
