The recently adopted E-commerce Directive seeks to spur new growth in Europe's electronic marketplace. At the heart of this strategy is building greater business and consumer confidence in electronic trading by creating greater transparency and setting out important ground rules in key areas such as applicable law, electronic communications and contracts, and liability. Whether the Directive has succeeded in this mission remains to be seen.
