The natural gas industry, along with electric utilities and others, continues to struggle with containing and disposing of polychlorinated biphenyls (Pas). The EPA has now come forward with its final PCBs penalty policy that is designed to keep at a maximum the incentives of affected companies to comply with the applicable restrictions, to voluntarily disclose known problems, and to act promptly to minimize the hann arising from violations.
The PCB Ban
The Toxic Substances Control Act was passed in 1976 and banned the use of FCBs in all but a few limited applications. The regulations implementing the statute impose abanonthemanufacture,processinganddistribution of PCBs. The regulations also regulate the use, storage and disposal of the substance. Finally, they impose detailed recordkeeping and labeling requirements.
