Not Required by NGPA uring recent years, ;he transportation of D gas owned by third parties on interstate pipelines has become increasingly important. On most pipelines, the substantial increase in third-party transportation has raised a question in at least some minds concerning whether Section 401 of the Natural Gas Policy Act of 1978 required end-use curtailment of transportation in times of capacity shortages. In a recent decision, the D.C. Circuit upheld a FERC ruling that end-use curtailment under Section 401 of the NGPA is not required with respect to the transportation of gas not owned by the pipeline and that pro ram curtailment is acceptable. However, the court did remand the case in order to permit FERC to give a fuller explanation of how pro rata curtailment meets the consumer protection requirements of the Natural Gas Act of 1938.
