The question of E-mail and privilege/confidentiality has been a live issue in the United States for some years. As well as court decisions on the issue (US v Maxwell) various opinions have been given by state bar associations, including, most recently one given by the American Bar Association. The situation, however, is different in England where the issue remains unexplored by the Courts and it is therefore necessary to try and apply basic principles to the subject.
