✦ Synopsis
The German Department of Trade and Industry has issued a first Draft for the implementation of the E-Commerce Directive (2000/31/EC dated 8 June 2000). The Draft called 'Electronic Commerce Act' (dated 1 December 2000) mainly provides for changes and amendments to the German Teleservices Act from 1997. Since the Teleservices Act was the first law of its kind in Europe (see Wuermeling, CLSR 1998, p. 41) to set up a legal framework for electronic commerce, it partly served as a model for the Directive.Yet, the Directive requires substantial changes to the Teleservices Act.
