Adverse ruling in Grace lawsuit

The US District Court of Montana has granted the United States' motion for partial summary judgment on a number of issues in the government's pending lawsuit against W.R. Grace & Co for recovery of clean-up costs related to previously operated vermiculite (a hydrated silicate) mining and processing sites near Libby in Montana.

The supplier of sealants, coatings, catalysts and silica products says that as a result of the court's ruling it expects to take a pre-tax charge of at least US$20 million in the fourth quarter of its current fiscal year to adjust its accruals to its current estimate of the minimum probable liability that could result from this lawsuit.

The US Environmental Protection Agency claims that as at 31 December 2001 it had incurred response costs of approximately US$57 million, and it has estimated that its total costs could exceed US$100 million.
