THE COMPUTER LAW AND SECURITY REPORT (which might not), should be removed by making it Clear that copyright protection extends to works 'fixed in any form from which they can be reporduced'.
The 1985 Act effectively achieved this in relation to works created in Computer memory. Doubts still remain, however, over works first created in non human-readable form on media other than COmPUter memories (eg perhaps intended for ultimate loading into a computer, but on media unattached to a computer at the time of creation of the works). The new legislation will make it clear that copyright subsists in works fixed in any form from which they can in principle be reproduced.
The words 'in principle' are included in this formula to indicate that the commonplace anti-copying measures incorporated in either hardware or software will not preclude the subsistence of copyright in the work.
