Abstract

This paper surveys the criminal provisions of federal environmental statutes. It discusses whether the violation be “knowing” or intentional and when corporate employees may be liable for criminal violations without any personal involvement in environmental crimes. The paper surveys the criminal provisions under the Clean Water Act, the Clean Air Act, the Resource Conservation and Recovery Act, the Comprehensive Environmental Response Compensation and Liability Act, the Emergency Planning and Community Right‐to‐Know Act and the Toxic Substances Control Act.
