Contaminated sites cause direct or indirect effects on the environment and on human health. In Germany the initiators of environmental pollution are normally required to pay for the control of pollution or for the restoration of damaged areas. Frequently, however, liability cannot be assigned, due to, for instance, limited liability or an inability to attach individual causation, and restoration has to be ®nanced by the state. This paper examines the scale of contamination and the economic problems that are associated with the application of civil and public liability for contaminated land in Germany. Different models of ®nancing restoration and their regional and environmental impacts are also discussed.
