โฆ Synopsis
This article starts from the fundamental proposition that the federal government has not preempted the state's role with respect to the issue of natural gas bypass-that the state's role in matters of local concern involving energy policy has been left to the state. If that is not true, and, in fact, the federal government has stripped the states of this local responsibility, then there is little to do except participate in proceedings before the Federal Energy Regulatory Commission and await the outcome as to the impact upon the state of Michigan. To the extent any federally permitted bypass impairs the ability of our distribution utilities to recover costs, agencies at the state level, such as the Michigan Public Service Commission, are going to have to tidy up after FERC and send larger bills along to the local distribution companies' remaining customers.
