Abstract

This survey studied Medicaid policies on reimbursing long‐term care facilities for costs associated with legal risk management programs. Of the 45 responding jurisdictions, 26 allow risk management reimbursement (within allowable limits) as a general administrative expense, while 19 states do not reimburse for risk management costs. To the extent that (a) risk management can be demonstrated as cost/beneficial, and (b) that Medicaid policy influences institutional behavior, states should liberalize Medicaid reimbursement for risk management in long‐term care.
